I’m so naive I had no idea this could happen.

STOCKTON, CA … 6 a.m. on Tuesday… [Kenneth Wright] came downstairs in his boxer shorts as a S.W.A.T team barged through his front door. Wright said an officer grabbed him by the neck and led him outside on his front lawn.

“He had his knee on my back and I had no idea why they were there,” …

officers also woke his three young children ages 3, 7, and 11 and put them in a Stockton police patrol car with him …for six hours… Officers then searched his house…

The U.S. Department of Education issued the search and called in the S.W.A.T for his [estranged] wife’s defaulted student loans.

According to the Department of Education’s Office of the Inspector General, the case can’t be discussed publicly until it is closed, but a spokesperson did confirm that the department did issue the search warrant at Wright’s home.

Defaulted Student Loan = SWAT team??!?!?

And this is not just your ordinary local city SWAT team — it’s a Federal SWAT team.

The Office of the Inspector General has a law enforcement branch of federal agents that carry out search warrants and investigations.

Stockton Police Department said it was asked by federal agents to provide one officer and one patrol car just for a police presence when carrying out the search warrant.

Stockton police did not participate in breaking Wright’s door, handcuffing him, or searching his home.

Fear. Intimidation. Unaccountability.

    Inexcusable. Also, probably actionable. I smell lawsuit.

    “Reckless endangerment” to start, plus anything else I can think of. Including the judge who thought it was a good idea to sign the warrant.

    A: Everyone involved in authorizing this should be fired. Immediately. Then sued for everything they’ve got or ever will have.
    B: Every sorry excuse for a lawman who takes part in something like this should be immediately fired, and forbidden from ever wearing a badge again. Sue them too, if you can.
    C: It’s obvious that if DoE has enough time and money for crap like this, their budget needs some serious cutting.

    This is not good, regardless of the mitigating factor of it being in Stockton.

    Even the possums in Stockton have prison tats and want to cap a cop. If their cross eyed its because they are stoned out of their minds!

    What Firehand said. This is inexcusable excess. If defaulting on student loans is a crime, it’s a white collar crime, with no history of violence or threats of violence. Using SWAT was criminal. Those kids will never forget that and the father will have nightmares.
    I hope that family collects more than enough to pay off the loans.

    The Jews could not fight back because their weapons had been first registered and then confiscated. That’s why I always shake my head in wonder anytime I hear a Jewish or black person come out in favor of firearm “control”. Firearm “control” first became “popular” in the USA after the Civil War as a way to keep blacks defenseless. Jews of all people should understand that citizens need access to firearms.

    The deeper issues with this have to do with the “searching” these assholes do.

    Defaulted on a loan, and they send these morons in to search for *what* exactly? Cash lying around? Who the hell in their right mind thinks a cop is going to honestly turn over said cash even if they were to find some?

    Of course, that’s not all they do. They don’t just ransack your home, breaking and destroying more than thieves would, they will confiscate anything else that might “be pertinent to the investigation”

    Say goodbye to your computer, your cell phone, your iPad, your laptop, and so on, because you’ll likely never see them again. If you do, the probability that they will be completely broken or reformatted (with no OS) is a high likelyhood.

    And you’d better not have one single mp3 or piece of software of questionable origin, otherwise you will be charged with whatever the latest felony is that the RIAA and such have come up with for that crap.

    I wonder what “probable cause” they used to do a SWAT raid.
    Might be grounds for a perjury charge, but that means the DoJ would have to prosecute. Yeah, like that‘s gonna happen.

    Pretty tough getting a civil lawsuit against the Feds.

    My main problem with this kind of thing is that every two-bit agency in the federal gov’t seems to have police power nowadays, and they all want to justify their budgets by showing their masters how well they can throw their weight around. It’s the same crap that happened to Koresh and Weaver when the ATF decided to go postal.

    No one should be surprised that the TWAT teams are now Obama’s loan collection agencies. They murder Marines, kill dogs as children look on in horror, murder retarded teens who ‘charge at them’ even though unarmed… they gun down people holding cell phones, murder mental patients waving fluorescent light bulbs at them thinking they have ‘light sabers’.
    Time for the People to realize – the bad cops are NOT the exception – they are the standard, and the TWAT teams are the scum de la scumma… they are the wannabe SS, or the KGB/ NKVD thugs. Seen it all before in other lands. They think that they are gods, immune to prosecution or punishment, and free to terrorize, torture or murder who they wish.
    Someday, anyone in a uniform will be a target.

    Very true. In the 70′s, my grandparents’ home was broken into and the thieves, three teenage boys, took a basketball sized sack of US coins, all dating from 1790′s thru about 1915. My grandfather got their license number as they drove off, and they were picked up within the hour. The coins, worth thousands of dollars, were impounded by the county cops for evidence. My grandfather never saw his coins again.

    The Student Loan program was taken over by the Federal Gummint. That makes defaulting a Federal Crime.

    I’m surprised it isn’t already a first-degree felony.

    There are two sides to that argument. Your side (and mine) is obviously valid. Occasionally, the government oversteps its bounds, and the People need some defense.

    The other side is, the government has more and bigger guns. They already use tanks (modified armored cars with a battering ram) to break into suspected drug-houses. They have flash-bang grenades, tasers, and a whole armory of things we’re not allowed to have. And they never give up. Even if they break into the wrong house (more than a few times). They don’t apologize. They probably send you a bill for wasting their time.

    And it’s been proven over and over and over again (starting sometime around the Kent state shootings) that they will indeed fire without hesitation on citizens, whether the citizens are armed or not. And as far as I know, not one policeman in this country has ever been tried and convicted of killing a citizen. Some have received severe reprimands and made to promise not to do it again.

    I remember the old joke that starts “Hi, I’m from the govenment, and I’m here to help”.
    Now the line is “I’m from the government. Drop your pants.”

    I think Slobyskya has been there, done that. In old Russia, during the Potemkin Mutiny, some of the soldiers fired above the protestor’s heads, but that was an exception, and they were few.

    Today, the police will kill you if they get a chance, mainly because they know there will be no retribution.

    It’s certainly true that not all policemen are like this. But you only have to get killed once to ruin your whole day,

    I have been doing a bit more digging here..
    First, I stipulate excessive force (WAY excessive force) was used, and someone should answer for it.

    However, it looks like this was not a simple case of unpaid loans. Rather, it is apparently criminal matter; a case of organized fraud involving student loans (using other people’s identities to get loans and so forth)

    This does NOT however justify the actions of the SWAT team.
