I’m thinking that maybe all the damnation being heaped upon Chief Justice Roberts MAY just be a mite premature.
Consider these points
….
The Dems, during the whole legislative process passing Obamacare, swore up and down, repeatedly and loudly, it was NOT a tax. The Court says it IS a tax. The Dems lied.. about a tax.. imagine that!
At a stroke, the upcoming election has now been transformed into a national referendum on Obamacare; which Obama certainly does NOT want.
Obama has repeatedly gone out of his way to antagonize the shit out of the Court.
What other action could the Court have taken, without being TOO obvious about it, that would have done Obama greater political damage?
I strongly suspect the conservative elements of the Court may have deliberately colluded to hand Obama a rich, fragrant exploding cigar…
One does not get to be a Supreme Court justice without possessing considerable subtlety of mind; certainly more than that possessed by Obozo or any of his myrmidons.
I certainly would hesitate to play poker with ANY of them.., even Kagan.

It may take a week or so before the left realize just how big a sh!t sandwich Roberts handed to them.
In retrospect any other ruling would only have kicked this problem way down the road. Now, because it’s a tax, everything goes back to the House and then to the Senate. This upcoming election just gets more important by the day.
I think it opened the door on taxing without apportionment, but it will take a long time for anything to change due to this fact.
Some of the justices can only be described as rat-bastard communists, but Roberts could have grown a pair and declared the law unconstitutional due to the direct language and how it was argued.

I couldn’t figure out yesterday why I was not pissed off at Justice Roberts. Later in the day it occurred to me. As Spin said, Roberts might have done us a favor. Consider this…
Barry already has demonstrated just this week that he doesn’t give a shit about the SCOTUS opinions. Roberts could have struck Obamcare down, but that would have enraged the leftist base and made it harder for us to throw out the asshole in chief. He would have installed Obamacare the fiat or executive order or some damn thing anyway. We’d be stuck with them for four years…or more.
By allowing the ruling to stand, I believe thhis may help Romney in a way he could not do himself. Attract the right-wing Tea Party folk to his campaign with cash and votes. The 2010 “shellacking” the Dems took may well look like an elementary school yard brawl compared to what is in store for the Dems in congress this year. And I’ll be there, on the phones. Stirring the pot. My last call maight be made on election day though. I’m getting tired.
Also, I can’t help but wonder if Roberts thought of this too and did it this way exactly for the reasons I mentioned. If he is a man of integrity, he’ll take the abuse he gets for this from us and we will never know.

2. The Supremes CLOSED the fucking door on the Commerce Clause!!
3. Every fucking TEA PARTY in these United States had a emergency meeting last night!!!
4. OBoBo now has one fucking option: CAMPAIGN on TAXING the middle class!!!!
5. 70 fucking % of Americans STILL oppose OBoBocare!!!!!
6. Likely futuah fucking argument: A fucking TAX has to originate in the fucking HOUSE, not the Senate!!!!!!
7. A hole buncha fucking STATES will decline OboBocare & OBoBo cain`t do a fucking thing about it!!!!!!!
8. Stoopid Party candidates who DO NOT sign in blood that they will vote to repeal fucking OBoBocare are fucking TOAST!!!!!!!!

But… but… but…. The Court decided it *wasn’t* a taxso that they could actually hear it this year [vs in a couplafew years] on the basis of the Anti-Injunction Act, which said a tax cannot be challenged in court until a real person has actually had to pay that tax.
What’re we gonna tax now?!? Refusal to buy a gym membership? Refusal to buy a Chevy reVolting?
I’m so confused I’m gonna need anti-seizure meds….

I don’t think the door was slammed on the Commerce Clause. The ramblings from Roberts were not a relevant part of the decision and are no more precedent than the dissenting justices’ opinions. What is precedent now is that the only obstacle in passing any future legislation is deciding how to make it tax based. Any blathering Roberts did would hold as much weight in a dissenting opinion as they did in his sellout. By re-writing the law, he put himself in the legislative camp. He violated the Constitution by doing so. He should be impeached and banned from the bench for life.
The decision might have fired up conservatives for a while and I’m glad Romney benefited from it financially but no one will remember this in November except the people who were not going to vote for Obama to begin with. With Romney Care there to haunt him, it’s child’s play to turn any negatives he might project on Obama right back on him.
Roberts handed Obama his second term and any positive spin put on this decision to the contrary is wishful thinking. If he was trying to set a trap for Obama, he was too clever by half.
If a ‘tax’ that ultimately ends up in private hands can be levied on you at the whim of the government is constitutional by Roberts’ way of thinking, just what could a future administration not do.
Just the word “jizya” sounds kinda pr0n to me, but maybe that’s just me.
Congress built a house. It’s got a red tile roof, purple drop siding, and orange and green trim. With gargoyles.
The building inspector comes out and looks at it. He says “electrical’s up to code, structure’s up to code, plumbing’s up to code.” He does NOT say “Burn it! Burn it with fire cause it’s the most hideous structure ever built!”
Same with Roberts. His job is to examine the mechanics of the law, not the esthetics. I don’t like his ruling either, but it’s a Christmas-in-July to the conservatives and independants, to galvanize them to remove Teh Won and his minions.
This “it’s not a tax but it IS a tax” should be hung around everyone who voted for this obscenity. Pitchforks and torches should be applied to those people that arranged for Al “Dull-Normal” Franken to become the 60th vote.
I’m more perurbed that it’s now officially okay to lie about receiving the Medal of Honor instead of getting the ass-beating such a statement deserves.
