A federal judge struck down Virginia’s ban on same-sex marriage today, an historic ruling with especial resonance on Valentine’s Day. Except the history of the historic ruling isn’t exactly up to par: Judge Arenda Wright Allen claimed the Constitution declares that “all men are created equal,” which is, instead, the first line of the Declaration of Independence.

Our Constitution declares that ‘all men’ are created equal. Surely this means all of us,” Judge Allen wrote on the first page of her opinion. That line opens the second paragraph of the Declaration of Independence and appears nowhere in the Constitution…

    It doesn’t matter what her reason is as long as she makes the ruling she likes to push her agenda. And our new democratic party AG will ensure the ruling stands by not defending the law to higher courts.

    Thomas Jefferson did NOT write that while inventing the light bulb. That’s a conspiracy theory.

    Abraham Lincoln carved it on Plymouth Rock just before he developed the Nuclear bomb -thus ending the 100 year revolutionary war.

    A graduate of the same school where Sharpton was gifted his Divinity degree, no doubt. After a display of ignorance like that, she should be disrobed and disbarred.

    The issue here isn’t who does what with whom in the bedroom, but the process of law and legislation.
    The Virginia AG took an oath to uphold the Virginia Constitution, which contains a “marriage is between a man and a woman” clause put there by the voters of Virginia a few years ago, yet he took the plaintiff’s side and argued against Virginia. He claimed not to do so would be “against his conscience”.
    If that were so, and he actually has a conscience, at the least he should have remained silent or more appropriately, resigned.
    The place to change that clause is in the Virginia legislature, and our triumvirate of new Proggies at the head of the Virginia government knows damn well they’d lose the battle there.
    I’m pretty damned sick and tired of Dems’ (yes AG ‘Red’ Herring is a Dem, how did you know?) mantra of “the law is for thee and a mere suggestion for me, to be applied when politically expedient.”

    Rule by judicial whim (trendiness or political agenda) is not “due process of law.”

    “All men are created equal” means that there is no separate law for commoners and for hereditary aristocracy/nobility, as there was in British law at the time of the Declaration (i.e. natural rights come from being human, not from hereditary class).

    This blithering hack would’a been a lot better off citing “equal protection,” which is a Constitutional provision under consideration.

    I wish I could take credit for Thomas Jefferson inventing the incandescent light bulb. A colleague told me that recently appeared on one of her student’s history exams. We were shaking our heads at how this kid could have gotten so confused.

    @5 That would be Equal Opportunity Employment (EEOC). When I got out of the Army in 1980 I applied for the LA Fire Dept. I was told I was a great candidate but they weren’t hiring white people.

    Don’t you know actual knowledge of the law isn’t required to be a judge, just a robe and an agenda?

    Also, to be declared “a scholar” of a particular document of law requires that you despise it with every fiber of your being and seek to destroy it, not that you know it well.

All Men May Have Been Created Equal Which Is Not Pary Of The Constitution But A Reverance In A Letter To The King Of England In Which Our Fore Fathers Were Setting A Standard To Let The King Know That We Declared Our Independence And We Were Equal To Him In Our Creation. Yes All Men Are Created Equal Where Ever You Maybe Born . BUT MEN OR MAN KIND CHOOSE DIFFERENT PATHS OR ARE DIRECTED TO DIFFERENT PATHS BY THEIR SURROUNDING OR GOVERNMENT OR ECONOMIC OPPORTUNITIES AND GEOGRAPHICAL LOCATIONS. THUS WE MAY ALL BE CREATED EQUAL BUT DO NOT AND CAN NOT ALL END UP EQUAL DUE TO AFFECTING CIRCUMSTANCES.
